Some of the family law services we provide include:

  • Uncontested / Contested Divorce: Divorce is the legal process that ends a marriage. Once a divorce is final, many legal rights and responsibilities for both the husband and wife are determined. An individual may file for a divorce in Oregon so long as he or she has been a resident of this state for six continuous months prior to the time that the divorce is filed. In Oregon, as in most states, divorce is no fault. This means that it does not matter who files for divorce first nor does it matter that only one spouse wants a divorce.

  • Child Support / Spousal Support: We offer effective legal representation in all custody and spousal support matters, including those that arise during a divorce, after a divorce or in a paternity proceeding.

  • Child Custody / Parenting Plans: Child custody involves the legal determination of which parent or parents (joint legal custody) will make decisions for the parties’ child. A parenting plan needs to be established which will give each parent a schedule of when he or she is able to spend time with his or her child. See information regarding paternity proceeding. Attorney Barbara J. Aaby has more than 15 years of family law experience dealing with child custody issues and parenting plans, and is the past Chair of the American Bar Association Committee on Child Custody.

  • Prenuptial Agreements / Cohabitation Agreements: Prenuptial agreements are agreements negotiated between prospective spouses that can be used to eliminate or alter rights and duties that the parties would have otherwise acquired during marriage. Prenuptial agreements can also be used to create new rights and duties that would otherwise not normally arise during a marriage.

  • Modification Proceedings: Our attorneys handle all modification proceedings, including motions for modification of child custody, child support and spousal support. Our attorneys also handle enforcement proceedings and motions to enforce court orders.
